This statement governs use of TRCS Hiroba (the "Software") and any drawings, layouts, schedules, or files it produces ("Outputs"). It applies in addition to the End User License Agreement.
What TRCS Hiroba is not. TRCS Hiroba is not a certified construction, architectural, structural, civil, mechanical, electrical, life-safety, survey, or permitting document, and must not be relied upon as one.
1. Accuracy & scale depend on the user
TRCS Hiroba renders geometry at the scale established and confirmed by the user during import. The accuracy of every Output therefore depends on the source data the user provides and the calibration and dimension confirmations the user performs. TRCS Hiroba does not independently verify the correctness of imported drawings, equipment dimensions, or placements.
2. User responsibility to verify
The user is solely responsible for independently verifying all dimensions, clearances, code compliance, and physical fit by direct measurement and qualified professional review before relying on any Output for procurement, construction, installation, equipment movement, safety planning, or any other decision.
3. No professional engineering or architectural services
TRCS Consulting Group LLC does not, through the Software, provide licensed engineering, architectural, surveying, or other regulated professional services. Outputs do not constitute professional certification and should be reviewed by appropriately licensed professionals where such review is required or prudent.
4. No warranty
The Software and Outputs are provided "as is," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
5. Limitation of liability
To the fullest extent permitted by law, TRCS Consulting Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising from use of or inability to use the Software or any Output. TRCS Consulting Group's total liability shall not exceed the fees paid for the Software in the twelve (12) months preceding the claim. The user assumes all risk arising from decisions made in reliance on Outputs.
6. Recommended notice on Outputs
The following appears on TRCS Hiroba printed sheets and should accompany any shared Output:
"Scaled space-planning reference only — not a construction, architectural, engineering, survey, or permitting document. Verify all dimensions on-site before acting."
